The introduction of Joint and Several Liability (JSL) legislation, now in force from April 2026, represents one of the most significant shifts in supply chain compliance the contingent workforce sector has seen. The legislation targets the top-most agency or Managed Service Provider in the chain, meaning MSPs can no longer treat tax compliance as someone else's problem. If an umbrella company fails to pay the correct PAYE or National Insurance to HMRC, that liability transfers up the chain and there is no safe harbour, even for those with rigorous due diligence in place.
